What is the American With Disabilities Act (ADA)?

The ADA is a civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life, including jobs, schools, transportation, and all public and private places that are open to the general public. The purpose of the law is to make sure that people with disabilities have the same rights and opportunities as everyone else. The ADA gives civil rights protections to individuals with disabilities similar to those provided to individuals on the basis of race, color, sex, national origin, age, and religion. Why does ADA website compliance matter?

  • You could be sued for tens of thousands of dollars under the ADA – watchdog groups conduct sweeps on the web to find websites that aren’t ADA compliant.
  • In 2017, there were 814 federal lawsuits related to website accessibility, with the majority being from New York and Florida.

Does ADA website compliance apply to my business site?

If your business has 15 or more employees, your site (and business) must comply with Title III.

If you have one or more of the following items on your site, you could be held liable:

  • Images without alternative text
  • Audio and video without transcription
  • Image maps
  • Strobes
  • Plugins and page layouts that aren’t accessible to assistive technologies
